SVR Family Law Successfully Defends Three Appeals in Significant Parenting Case

Kristin Smith of SVR Family Law achieved a major courtroom victory for her client by defending three separate appeals arising from a complex and hard-fought family law matter.

The appeals stemmed from a series of earlier parenting proceedings, including an interim parenting application, an application to introduce fresh evidence, and a two-day parenting trial. After being unsuccessful at each stage, the opposing party brought three individual appeals, requiring a full and detailed response to each. All three appeals were heard together in a single day before the Court of King’s Bench of Alberta. Justice Carruthers dismissed each appeal in its entirety, confirming the original decisions and bringing long-awaited finality to the matter.

In dismissing the appeals, the Court reaffirmed key principles that are central to family law, including the strict limits on introducing fresh evidence post-trial, and, most importantly, the paramount importance of the best interests of the child. The Court found no basis to procedural fairness allegations raised by the Appellant and noted that there were no legal or factual errors in the trial justice’s application of the law to the evidence presented in each matter.
